1. GENERAL PROVISIONS

The Spanish restaurant Ole Galán, located in Torremolinos, through its official website https://olegalan.es/ (hereinafter referred to as the Seller), publishes this public offer contract (hereinafter referred to as the Contract). This contract regulates the sale of gastronomic products and services offered on its website to individuals and legal entities (hereinafter referred to as the Buyer) and is legally binding under current Spanish law.
1.2. The use of services and purchase of products through the website https://olegalan.es/ implies the acceptance of conditions, prices, terms, and other provisions specified in this document.
1.3. By accepting this Contract, the Buyer confirms that:
A) They are at least 18 years of age at the time of purchase.
B) The information provided when placing the order is accurate and up to date.
C) The contact information provided may be used to inform them about the order status, restaurant policies, promotions, or other relevant information.
2. OBJECT OF THE CONTRACT
2.1. The Seller agrees to prepare and deliver gastronomic products to the Buyer according to the prices in effect at the time of placing the order, and the Buyer agrees to pay for these products under the terms of this Contract.
2.2. The prices of products listed on the website are in euros (€) and include applicable taxes, such as VAT. Delivery costs are calculated separately based on the rates of the selected transportation service.
3. ORDER PLACEMENT AND CONTRACT EFFECTIVENESS
3.1. The text of this Contract constitutes a public offer. By placing an order, the Buyer accepts the terms of this Contract in full.
3.2. The contract becomes effective when the Buyer completes the payment for the order. Until payment is confirmed, the order will not be processed or considered valid.
3.3. Once payment is processed, the Seller confirms the order via email or text message (SMS), at which point the purchase contract is considered fully effective.
4. RETURN POLICY
4.1. Due to the nature of food products, returns or refunds are not accepted once products are delivered, except if the product does not match the order specifications or is in poor condition at the time of delivery.
4.2. The Buyer must notify the Seller immediately upon receiving the order if there are any issues, so the Seller can assess the situation and propose a solution.
4.3. Returns are not accepted due to changes in the Buyer’s preference or opinion once the product has been delivered.
5. PAYMENT FOR PRODUCTS
5.1. Payment for products and services is made in euros (€) and in accordance with the prices listed on the website https://olegalan.es/ at the time of purchase.
5.2. Payments must be completed before order processing and are made through the methods accepted on the website.
5.3. Incomplete or failed payments may result in order cancellation at the Seller’s discretion, without liability.
6. DELIVERY OF PRODUCTS
6.1. Product delivery is conducted through third-party taxi services and is available only within the coverage area specified on the website.
6.2. The Buyer is responsible for providing an accurate address within the delivery area. The Seller is not responsible for delays or failed deliveries due to incorrect or incomplete information provided by the Buyer.
7. PROTECTION OF PERSONAL DATA
7.1. In compliance with the General Data Protection Regulation (GDPR) and Spanish law, the Buyer’s personal data will be treated confidentially and used exclusively for order management, product delivery, and sending promotional information if the Buyer has consented.
7.2. The Buyer has the right to access, rectify, and delete their personal data by contacting the Seller through the email provided on the website.
8. LIABILITY AND LIMITATIONS
8.1. The Seller is not responsible for any misuse of the products by the Buyer or for any consequences resulting from such misuse.
8.2. The Seller assumes no liability for issues related to external circumstances affecting order processing, including transportation delays by third parties.
9. MODIFICATION OF THE CONTRACT
9.1. The Seller reserves the right to modify this Contract at any time, with such modifications becoming effective upon publication on the website.
10. FORCE MAJEURE
10.1. Both parties are exempt from liability for non-compliance with contract obligations in cases of force majeure, including extraordinary and unavoidable circumstances that prevent either party from fulfilling their obligations. Force majeure events may include natural disasters (earthquakes, floods, etc.), social events (wars, emergencies, epidemics), and government measures (transport restrictions, currency limitations, international sanctions, and trade prohibitions).
10.2. During the period of force majeure, neither party shall have any claims against the other, and each party assumes the risks associated with these events.
11. COPYRIGHTS
11.1. All text and graphic content on the website https://olegalan.es/ are the property of the Seller and/or its suppliers and may not be reproduced or used without authorization.
12. INFORMATION AND DATA USE
12.1. The Buyer agrees to provide accurate and truthful information as necessary for the provision of services and/or purchase of goods.
12.2. The Seller reserves the right to request proof of accuracy if needed, and providing false or misleading information may result in order cancellation without liability.
